That sucks, man. I’m sorry. I used to have a clothing company, known mostly for one-of-a-kind hand-knits. All my pieces were very distinctive, especially the patterns of color I would use. Each piece was unique.
Well, in the fashion business one only needs to change one or two small details to be free of “copying” your design.
So one day, someone forwarded to me the merchant site page from Wal-Mart (!!!) of one of the Olsen Twins new KNIT COATS. It was almost an exact copy of one of the hand-knit coats I had delivered to Fred Segal (a popular boutique in L.A.) that season. How’d I know it was mine? Becasue I only made one with that color combination/pattern.
Have you read the Innovative Design Protection and Piracy Prevention Act ? It’s kind of a double edged sword. Why? My friend, who is a fashion designer, said this: Let’s look back on that blue pea coat with wood buttons you made last year. Let’s say it was moderately popular and a dozen or so boutiques each ordered a size run. Now let’s say a buyer from the fictitious company Mega-Super-Fashion comes along, sees your pea coat and says to himself, ‘Hmm, I could easily reproduce these in my multi-million dollar factory, take a few stylish snapshots, and sell them as my own and make a killing.’ Right about now you’re probably thinking, ‘thank goodness I’d be covered by the Innovative Design Protection and Piracy Prevention Act.’ Unfortunately, it’s this very act that could be fodder for M-S-F to sue you.
